Pemenuhan Hak Anak Atas Pendidikan Dasar Berdasarkan Perspektif Hukum

Pelaksanaan pendidikan wajib belajar 9 tahun yang telah diatur dalam Undang-Undang Nomor 20 tahun 2003 tentang Sistem Pendidikan Nasional, Pemenuhan hak anak atas pendidikan dasar berdasarkan persepektif hukum merupakan hal yang harus dilakukan oleh pemerintah daerah, dimana hak-hak anak tersebut dilindungi oleh Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak dan Undang-Undang Nomor 4 Tahun 1979 Tentang Kesejahteraan Anak. Tujuan penelitian ini adalah Untuk mengetahui kewajiban negara dalam memberikan pendidikan dasar yang wajib dan cuma-cuma bagi anak dan pelaksanaan pemenuhan hak anak atas pendidikan dasar di pemerintah daerah. Sumber data yang digunakan dalam penelitian ini berupa data primer dan data skunder. Data Primer, yaitu data yang diperoleh langsung dari lapangan yang bersumber dari hasil wawancara dan kuisioner yakni berupa daftar pertanyaan yang berkaitan langsung dengan substansi penelitian ini. Data sekunder, adalah data yang diperoleh dari kepustakaan melalui penelusuran literature, hasil-hasil penelitian dan peraturan perundang-undangan yang relevan dengan masalah atau substansi penelitian ini. Hasil penelitian menunjukkan bahwa negara yang diwakili pemerintah sebagai pihak pertama yang bertanggungjawab dalam penyelenggaraan pendidikan, memiliki kewajiban dalam pemenuhan hak anak atas Pendidikan Dasar. Pelaksanaan pendidikan dasar yang seharusnya bersisifat wajib dan cuma-cuma masih kurang berhasil, serta adanya sarana dan prasarana yang tidak lengkap menyebabkan kurang efektifnya pelaksanaan pendidikan dasar, sehingga berdampak pada pemenuhan hak anak atas pendidikan dasar. Dalam proses penyelenggaraan pendidikan dan pengembangan sarana dan prasarana belum tepat sasaran dan dapat dipertanggungjawabkan, sehingga menyebabkan kurang efektifnya pelaksanaan pendidikan dasar di Kota Mataram, dan berdampak pada pemenuhan hak anak atas pendidikan dasar yang belum optimal.
Fulfillment of Children’s Rights to Basic Education Based on Legal Perspective
Abstract
The implementation of the 9-year compulsory education that has been regulated in Law Number 20 of 2003 concerning the National Education System, Fulfilling children's rights to basic education based on a legal perspective is something that must be done by local governments, where the rights of these children are protected by law Law Number 23 of 2002 concerning Child Protection and Law Number 4 of 1979 concerning Child Welfare. The purpose of this study is to find out the state's obligation to provide compulsory and free basic education for children and the implementation of fulfilling children's rights to basic education in local governments. The data sources used in this research are primary data and secondary data. Primary data, namely data obtained directly from the field which is sourced from interviews and questionnaires, namely in the form of a list of questions that are directly related to the substance of this research. Secondary data, is data obtained from the literature through literature searches, research results and laws and regulations that are relevant to the problem or substance of this research. The results of the study show that the state, which is represented by the government as the first party responsible for administering education, has an obligation to fulfill children's rights to basic education. The implementation of basic education which should be compulsory and free of charge is still not successful, and the existence of incomplete facilities and infrastructure has resulted in the ineffectiveness of the implementation of basic education, which has an impact on fulfilling children's rights to basic education. In the process of organizing education and developing facilities and infrastructure it has not been on target and can be accounted for, resulting in less effective implementation of basic education in the City of Mataram, and an impact on fulfilling children's rights to basic education which has not been optimal.
