Perlindungan hukum terhadap nasabah merupakan elemen fundamental dalam menjaga kepercayaan publik terhadap sistem perbankan syariah. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi nasabah penyimpan dana serta mengevaluasi implementasi prinsip kehati-hatian dan kerahasiaan bank dalam kerangka Undang-Undang No. 21 Tahun 2008. Menggunakan pendekatan hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analitis, penelitian ini mengkaji berbagai sumber hukum primer, sekunder, serta melakukan triangulasi wawancara terhadap praktisi perbankan syariah. Hasil penelitian menunjukkan bahwa perlindungan terhadap nasabah masih belum sepenuhnya efektif karena regulasi yang belum spesifik terhadap karakteristik akad-akad syariah serta implementasi prinsip kehati-hatian yang belum optimal. Peran Lembaga Penjamin Simpanan dalam menjamin dana nasabah masih berbasis model konvensional dan belum sepenuhnya kompatibel dengan prinsip syariah. Studi komparatif dengan sistem perbankan syariah di Malaysia menunjukkan pentingnya penguatan kerangka regulasi yang spesifik dan harmonis. Implikasi dari penelitian ini menggarisbawahi perlunya pembaruan kebijakan dan koordinasi antar lembaga guna memperkuat perlindungan hukum berbasis syariah, serta peningkatan tata kelola dan transparansi bank syariah di Indonesia.
Legal Protection for Depositors in the Islamic Banking System in Indonesia
Abstract
Legal protection for depositors is a fundamental pillar for maintaining public trust in the Islamic banking system. This study aims to analyze the legal mechanisms safeguarding depositors and evaluate the implementation of prudential and confidentiality principles under Law No. 21 of 2008. Employing normative legal research methods with statute, conceptual, and analytical approaches, the study reviews primary and secondary legal sources, supported by interviews with Islamic banking practitioners. The findings reveal that existing legal protection remains inadequate due to non-specific regulations that fail to address the unique features of Sharia-based contracts, alongside suboptimal implementation of prudential principles. The role of the Deposit Insurance Corporation (LPS) in guaranteeing deposits is still modeled on conventional systems, raising concerns over Sharia compliance. Comparative analysis with Malaysia's Islamic banking framework underscores the importance of developing harmonized and Sharia-compliant regulatory models. The study concludes by recommending policy reforms and institutional coordination to strengthen Sharia-based legal protection, enhance governance, and increase transparency in Indonesia’s Islamic banking sector.
