Nusyuz Suami dan Implikasinya terhadap Harmonisasi Hubungan Suami Istri (Studi Kasus Penyelesaian Kasus Nusyuz)

Problematika nusyuz selama ini hanya sering ditujukan kepada istri sebagai pelaku, padahal dalam kenyataannya suami juga bisa melakukan hal yang sama, fenomena nusyuz suami kini semakin nampak ke permukaan yaitu dengan indikasi yang sama dengan perilaku nusyuz istri. Fenomena nusyuz suami yang terjadi di Desa Lantan ini kemudian memberikan dampak yang signifikan erhadap keharmonisan rumah tangga, karena perilaku nusyuz tersebut meliputi pengabaian hak nafkah dan juga sampai pada penelantaran hak. Penelitian ini merupakan penelitian kualitatif karena menggali dan meneliti fenomena hukum yang terjadi di lapangan, sumber data pada penelitian ini yaitu data primer dan sekunder dengan prosedur pengumpulan data berupa wawancara, observasi dan dokumentasi. Hasil penelitian ini menunjukkan bahwa nusyuz suami terbentuk dari konfigurasi faktor internal dan eksternal, faktor eksternal meliputi, norma adat dan budaya lokal, peran tokoh agama dan tokoh adat, sistem hukum dan kebijakan sosial serta lingkungan sosial. Faktor internal meliputi, aspek psikologis, kondisi ekonomi, tingkat pendidikan dan kurangnya literasi agama. Dominasi faktor-faktor meliputi, kombinasi antara tekanan ekonomi dan budaya patriarki, rendahnya literasi agama dan lemahnya peran tokoh otoritatif, dan pengaruh lingkungan sosial. Sedangkan implikasi nyata dari mekanisme pengaruh nusyuz suami berdampak pada, aspek ekonomi, aspek komunikasi dan juga berdampak terhadap relasi keluarga

The Nusyuz of Husband and its Implications on the Harmonization of Marital Relationships (Case Study of Nusyuz Case)

Abstract

The issue of nusyuz has often been directed solely at wives as perpetrators, even though in reality husbands can also commit the same thing. The phenomenon of husband’s nusyuz is now increasingly visible to the surface, namely with the same indications as the behavior of wife’s nusyuz. The phenomenon of husband’s nusyuz which occurs in Lantan Village has had significant impacts on the household harmony, because this behavior includes the carelessness of the right to financial support and even abandoning rights. This research was qualitative research because it explored and examined legal phenomena occurring in the field. The data sources in this research were primary data and secondary data, with data collection procedures in the form of interviews, observation, and documentation. The results of this research showed that the nusyuz of husband is formed from a configuration of internal and external factors. The external factors include custom norms and local cultural, the roles of religious and traditional leaders, the legal system and social policies, and the social environment. The internal factors include psychological aspects, economic conditions, education levels, and a lack of religious literacy. The factors of domination include the combination between economic pressure and patriarchal culture, low religious literacy  and  weak  authoritative  figures,  and  the  influence  of  the  social environment. The behavior of husband’s nusyuz also has impacts on the lack of trust among family members and the deterioration of communication quality. Meanwhile, the real implications of the mechanism of husband's nusyuz influence have impacts on economic aspects, communication aspects, and also family relationships.
