Penelitian ini membahas implementasi hak nafkah anak pasca perceraian dalam perspektif Hukum Keluarga Islam dengan fokus pada ketentuan Kompilasi Hukum Islam (KHI) dan fikih Islam. Perceraian tidak menghapus kewajiban orang tua, khususnya ayah, untuk memenuhi nafkah anak sebagai bagian dari hak anak dalam Islam. Namun, dalam praktiknya masih terdapat kesenjangan antara ketentuan normatif dalam KHI dengan implementasinya di masyarakat. Penelitian ini bertujuan untuk menganalisis konsep kewajiban nafkah anak pasca perceraian menurut Al-Qur’an, hadis, fikih Islam, dan KHI, serta mengkaji faktor-faktor yang memengaruhi implementasinya dalam hukum keluarga di Indonesia. Penelitian ini menggunakan metode penelitian kepustakaan (library research) dengan pendekatan kualitatif-normatif. Data diperoleh dari sumber primer berupa Al-Qur’an, hadis, dan Kompilasi Hukum Islam, serta sumber sekunder berupa kitab fikih, seperti Fiqh Sunnah dan Al-Fiqh Al-Islami wa Adillatuhu, artikel jurnal, dan kajian ilmiah terkait implementasi nafkah anak pasca perceraian. Analisis data dilakukan melalui teknik content analysis untuk mengkaji kesesuaian antara norma hukum Islam dan implementasinya dalam praktik. Hasil penelitian menunjukkan bahwa Islam dan KHI secara tegas menempatkan ayah sebagai pihak yang bertanggung jawab terhadap nafkah anak meskipun telah terjadi perceraian. Akan tetapi, implementasi kewajiban tersebut belum berjalan optimal karena dipengaruhi oleh faktor ekonomi, rendahnya kesadaran hukum, dan lemahnya pelaksanaan putusan nafkah anak sebagaimana ditemukan dalam berbagai kajian ilmiah dan literatur hukum keluarga Islam. Penelitian ini menegaskan bahwa hak nafkah anak tidak hanya memerlukan dasar normatif yang kuat, tetapi juga mekanisme pelaksanaan yang efektif.

Implementation of Children’s Maintenance Rights After Divorce According to the Compilation of Islamic Law

Abstract

This study discusses the implementation of children’s post-divorce financial support rights from the perspective of Islamic Family Law, focusing on the provisions of the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) and Islamic jurisprudence. Divorce does not eliminate the obligations of parents, particularly fathers, to provide financial support for their children as part of the protection of children’s rights in Islam. However, in practice, there remains a gap between the normative provisions of KHI and their implementation in society. This study aims to analyze the concept of children’s financial support obligations after divorce according to the Qur’an, hadith, Islamic jurisprudence, and KHI, as well as to examine the factors influencing their implementation within family law in Indonesia. This research employs a library research method with a qualitative-normative approach. Data were obtained from primary sources, including the Qur’an, hadith, and the Compilation of Islamic Law, as well as secondary sources such as classical Islamic jurisprudence books, including Fiqh Sunnah and Al-Fiqh Al-Islami wa Adillatuhu, journal articles, and scholarly studies related to the implementation of child support after divorce. Data analysis was conducted using content analysis techniques to examine the conformity between Islamic legal norms and their implementation in practice. The results of the study indicate that Islam and KHI explicitly place fathers as the parties responsible for providing financial support for their children despite the occurrence of divorce. However, the implementation of this obligation has not been fully optimal due to economic factors, low legal awareness, and weak enforcement of child support decisions, as identified in various scholarly studies and Islamic family law literature. This study emphasizes that the protection of children’s financial support rights requires not only a strong normative foundation but also effective enforcement mechanisms.
