Analisis Yuridis Kebijakan Repatriasi Foreign Terrorist Fighters Isis Dalam Kerangka Hukum HAM Internasional

Pasca kekalahan teritorial Islamic State of Iraq and Syria (ISIS), perdebatan mengenai langkah yang harus diambil negara-negara terhadap Foreign Terrorist Fighters (FTFs) dari warga negaranya menjadi semakin relevan namun kontroversial. Penelitian ini menganalisis secara kritis apakah negara asal memiliki kewajiban untuk merepatriasi FTFs ISIS berdasarkan hukum internasional, serta mengidentifikasi pilihan-pilihan yang tersedia bagi negara dalam menangani pejuang ISIS yang kembali berdasarkan pendekatan hak asasi manusia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kerangka hukum internasional saat ini bergerak menuju repatriasi FTFs untuk tujuan penuntutan dan rehabilitasi, meskipun tidak terdapat kewajiban hukum yang eksplisit. Penelitian ini menyimpulkan bahwa opsi repatriasi dan penuntutan yang adil di negara asal dipandang sebagai pendekatan yang paling komprehensif dan disukai, tidak hanya untuk negara asal tetapi juga untuk komunitas internasional secara keseluruhan dalam jangka panjang.
